Prosecutions
We can (and do) carry out legal prosecutions against individuals, employers or businesses who have breached WHS laws.
Prosecutions are one of several compliance options available under legislation. It is a discretionary action and only carried out where it is in the public interest.
Work health and safety incidents
When an incident may have occurred, we may send inspectors to carry out investigations.
These investigations help us determine:
- exactly what caused the incident
- the lessons learnt to improve workplace safety and prevent injuries
- whether prosecution is warranted
During our investigations we may need to liaise with other agencies to determine jurisdiction and which agency has the lead role in an investigation.

Consideration of a prosecution
A number of issues are considered when determining whether to start a prosecution. We set these out in our prosecution guidelines.
The Coroner may also be involved (in a fatality) to determine the manner and cause of death. We may provide the Coroner with a report.
The evidence from the Coronial inquest may also be used by us in any prosecution.
Requesting a prosecution
This information is only relevant to prosecution under the Work Health and Safety Act 2011.
A person can ask us to start a prosecution if:
- they believe a category one or two offence under the Work Health and Safety Act 2011 has occurred
- at least six months (but not more than 18 months) have passed following the incident and we have not started a prosecution
The request must be in writing using the request form (PDF, 140.1 KB) or by letter sent to us by mail.
The request should include:
- the facts of the event
- the date, place and names of the people concerned
- the nature of the offence you believe has occurred
- the person you believe committed the offence
We will provide a written response to a request within three months, and advise you whether the investigation is complete, and if it is complete whether a prosecution will be brought.
If the decision has been made not to bring a prosecution, we must tell you the reasons for that decision. You can ask the Director of Public Prosecutions to further consider the matter if you wish.

On 12 July 2021 a tower crane operator was operating a crane via remote control from the ground level. At approximately 1.42pm, while the remote-control unit was unattended, the crane slewed causing the hook block, lifting chains and hoist rope to strike and cause damage to the north eastern façade of a building before becoming entangled in air conditioning services on the roof top, before coming to stop
After a SafeWork NSW investigation the defendant, Modco Homes Pty Ltd, was charged with one breach of section 38(1), two breaches of 39(1) and three breaches of sections 32/19(1) of the Work Health and Safety Act 2011.
On 2 December 2024, the defendant was convicted by the District Court and fined a combined total of $225,000 for the offences.
Bay Timber Manufacturing Pty Ltd

On 6 December 2021, a worker suffered injuries when her leg was trapped by a metal coil that fell while it was being moved by an overhead crane.
After a SafeWork NSW investigation the defendant, Bay Timber Manufacturing Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 12 December 2024, the defendant was convicted by the District Court and fined $300,000.
Richard Crookes Constructions Pty Ltd

On 29 April 2020, a 36 year old senior crane operator and dogman suffered serious injury when he fell approx. 2.9 metres through an inadequately protected penetration and was impaled by reinforcing bar.
After a SafeWork NSW investigation the defendant, Richard Crookes Constructions Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 12 December 2024, the defendant was convicted by the District Court and fined $150,000.
State Of New South Wales (Department Of Communities And Justice, Corrective Services NSW)
20 December 2024
On 19 December 2020, two Custodial Officers at the Mid North Coast Correctional Centre were entering the staff post when they were ambushed by two inmates.
After a SafeWork NSW investigation the defendant, State Of New South Wales (Department Of Communities And Justice, Corrective Services NSW), was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 20 December 2024, the defendant was convicted by the District Court and fined $600,000.
The Salvation Army (New South Wales) Property Trust

On 27 February 2021 a 76 year old male resident of an aged care facility was being transferred via a full hoist patient lifter in a patient sling to transfer him to a tub chair when the Spreader Bar released and he fell. The IP subsequently died from the injuries.
After a SafeWork NSW investigation the defendant, The Salvation Army (New South Wales) Property Trust, was charged with a breach of section 32/19(2) of the Work Health and Safety Act 2011.
On 20 December 2024, the defendant was convicted by the District Court and fined $300,000.
Bermagui Constructions Pty Ltd

On 9 February 2021 a worker was seriously injured when he fell approximately 5m through a roof structure to the ground below.
After a SafeWork NSW investigation the defendant, Bermagui Constructions Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 20 December 2024, the defendant was convicted by the District Court and fined $225,000.

DNA Rooftiling Services Pty Ltd
4 November 2024
On 9 May 2022, a 30 year old male roof tiler sustained non-fatal injuries when an alfresco roof area gave way and collapsed at The Ponds.
A under section 155 of the Work Health and Safety Act 2011 requiring information was issued to DNA Rooftiling who failed to comply with the notice.
After a SafeWork NSW investigation the defendant, DNA Rooftiling Services Pty Ltd, was charged with a breach of section 155(5) of the Work Health and Safety Act 2011.
On 4 November 2024, the defendant was convicted by the Downing Centre Local Court and fined $4,000.
Capital Lines and Signs Pty Ltd
11 November 2024
On 20 September 2021, a worker sustained serious injury when he was struck by a Hydro Vac Truck.
After a SafeWork NSW investigation the defendant, Capital Lines and Signs Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 11 November 2024, the defendant was convicted by the Downing Centre Local Court and fined $38,000.
Troy Justen Adams
20 November 2024
On 26 July 2021, a worker sustained multiple crush injuries when he was struck by a bobcat.
After a SafeWork NSW investigation the defendant, Troy Justen Adams, was charged with a breach of section 32/27(1) of the Work Health and Safety Act 2011.
On 20 November 2024, the defendant was convicted by the Downing Centre Local Court and fined $30,400.
TJN Construction Group Pty Ltd
28 November 2024
On 2 December 2020, a worker was injured when he was in the process of waterproofing in a non-ventilated area, when a heat gun ignited the fumes of the chemicals and caused a fireball explosion.
After a SafeWork NSW investigation the defendant, TJN Construction Group Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 28 November 2024, the defendant was convicted by the District Court and fined $200,000.
Rahme Civil Pty Ltd and Rabih Rahme
28 November 2024
On 14 December 2025, a 23 year old leading hand, was instructed by the site supervisor to clean out sand from new foundations. During this process the sandstone footing supporting a section of brick wall were undermined, causing the wall to collapse, striking the worker and partially burying him with falling bricks and mortar.
After a SafeWork NSW investigation the defendants, Rahme Civil Pty Ltd, and the Director, Rabih Rahme, were respectively charged with a breach of section 32/19(2) and section 32/27(1) of the Work Health and Safety Act 2011.
On 28 November 2024 the defendants were convicted by the District Court with the corporate defendant fined $400,000 and the director defendant fined $50,000.
Form Group NSW Pty Ltd

On 24 August 2020, a worker was seriously injured when he was struck by 2-4 tonne bundle of reinforcement bars being moved by a tower crane.
After a SafeWork NSW investigation the defendant, Form Group NSW Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 28 November 2024, the defendant was convicted by the District Court and fined $180,000.
Twin Connect Pty Ltd

On 17 January 2022, a 32 year old worker sustained serious injury when she was struck/crushed by a mobile plant.
After a SafeWork NSW investigation the defendant, Twin Connect Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 29 November 2024, the defendant was convicted by the District Court and fined $180,000.

Thomas Bernard Cull

On 10 December 2020, while workers were pouring a strip footing around base of a 3.6m deep excavation, a section of the excavation collapsed, causing neighbouring homes to suffer major structural damage and partially collapse into the excavation at Bondi Beach.
After a SafeWork NSW investigation the defendant, Thomas Bernand Cull, was charged with a breach of section 32/28(b) of the Work Health and Safety Act 2011.
On 14 October 2024, the defendant was convicted by the Downing Centre Local Court and fined $30,000.
Neil O’Brien

JF Building Consultants Pty Ltd

On 18 March 2023, in Oran Park, an incomplete scaffold was observed with workers accessing the scaffold. On 31 March 2023, the scaffold was observed to be still incomplete but roof eaves had been installed indicating the defendant failed to prevent unauthorised access to it. There was a risk of fall as the scaffold was over 4m in height.
On 4 April 2023, in Box Hill, a worker was observed conducting construction work on an incomplete scaffold with risk to their health and safety from falls of approx. 4.3m to the ground below. The scaffold had not been inspected in over 30 days since the last inspection certificate.
After a SafeWork NSW investigation the defendant, JF Building Consultants Pty Ltd, was charged with a breach of clause 225(5) and 225(3)(c) of the Work Health and Safety Regulation 2017. The defendant pleaded guilty to the clause 225(3)(c) offence and the clause 225(3)(c) offence was taken into account by the court on a Form 1 list of additional charge.
On 29 October 2024, the defendant was convicted by the Downing Centre Local Court and fined $10,000.
Avant Stone Pty Ltd
31 October 2024
On 20 August 2022, a 56-year old worker was moving stone slabs into storage with an overhead crane when two slabs fell, resulting in fatal crush injuries at Beresfield.
After a SafeWork NSW investigation the defendant, Avant Stone Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 31 October 2024, the defendant was convicted by the District Court and fined $450,000.
21st Century Building Services Pty Ltd

On 19 August 2020, a section of scaffold surrounding a worksite in Gosford the site collapsed due to wind onto a pedestrian footpath and struck a member of the public. damaging vehicles and a light pole at Gosford.
After a SafeWork NSW investigation the defendant, 21st Century Building Services Pty Ltd, was charged with two breaches of section 32/19(2) of the Work Health and Safety Act 2011.
On 31 October 2024, the defendant was convicted by the District Court and fined a total of $225,000 for both charges.

Mennen Construction Pty Ltd

On 6 September 2021, a worker was seriously injured when he was completing installation of roof flashing and fell approximately 3.4 meters onto concrete at Fairfield.
After a SafeWork NSW investigation the defendant, Mennen Construction Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 25 September 2024, the defendant was convicted by the District Court and fined $180,000.
Mark John Khoury

On 1 July 2021, the wall of a home in Leichardt collapsed into a neighbouring construction site where an excavation/trench had been dug along the boundary.
After a SafeWork NSW investigation the director of Buildmark Developments Pty Ltd, Mark John Khoury, was charged with a breach of section 32/27(1) of the Work Health and Safety Act 2011.
On 20 September the defendant was convicted by the District Court and ordered to complete a section 241 Training order and section 239 Work Health and Safety Undertaking.

After a SafeWork NSW investigation the defendant, Buildmark Developments Pty Ltd, was charged with a breach of section 32/19(2) of the Work Health and Safety Act 2011.
On 20 September the defendant was convicted by the District Court and fined $12,000.
JD Projects (NSW) Pty Ltd

On 25 January 2021, excavation on a property is believed to have undermined the foundations. Workers heard cracking and evacuated. Three floors came away from the building in its north eastern corner at Crows Nest.
After a SafeWork NSW investigation the defendant, JD Projects (NSW) Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 16 September 2024, the defendant was convicted by the District Court and fined $180,000.
Jason Reid Stitt

On 11 September 2019, a worker was standing on the top deck of a mobile scaffold undertaking a task. A ledger he was leaning on gave way and the worker fell approximately 5.7m. The worker sustained fatal injuries.
After a SafeWork NSW investigation the defendant, Jason Reid Stitt, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 2 September 2024, the defendant was convicted by the District Court and fined $100,000.

Chris Darby Strata Pty Ltd

On 12 June 2020, a 64 year old concrete finisher was attempting to open a damaged main front security gate manually to enter work, when it collapsed and fell onto him, pinning him to the ground causing fatal injuries at Berkeley.
After a SafeWork NSW investigation the defendant, Chris Darby Strata Pty Ltd, was charged with a breach of section 32/20(2) of the Work Health and Safety Act 2011.
On 22 August 2024 the defendant was convicted by the District Court and fined $150,000.
Scopeview Projects Pty Ltd and Cameron Doueihi
7 August 2024
On 14 December 2020 a worker was instructed to clean out sand from new foundations. During this process a section of brick wall collapsed, striking the worker and partially burying him.
After a SafeWork NSW investigation the defendants, Scopeview Projects Pty Ltd, and its director, Cameron Doueihi, were respectively charged with a breach of sections 32/19(1) and section 32/27(1) of the Work Health and Safety Act 2011 respectively.
On 7 August 2024 the defendants were convicted by the District Court with the corporate defendant fined $375,000 and the director defendant fined $60,000.
Arthur Karagavrilidis

On 31 March 2022, a worker was seriously injured when he fell approximately 7 metres from a scaffold to the ground below.
A notice under section 155 of the Work Health and Safety Act 2011 seeking information related to the incident was served on the defendant Arthur Karagavrilidis. The defendant was charged with a breach of section 155(5) for failure to respond to the notice.
On 5 August 2024, the defendant was convicted by the Downing Centre Local Court and fined $1,500.
July 2024
TQM Design & Construct Pty Ltd
16 July 2024
On 15 November 2021, a 23 year old supervisor and two 20 year old apprentice electricians were placed at risk of falling while installing a power cable for the tower crane at a construction site at Newcastle.
After a SafeWork NSW investigation the defendant, TQM Design & Construct Pty Ltd, was charged with a breach of section 33/19(1) of the Work Health and Safety Act 2011.
On 16 July 2024, the defendant was convicted by the Downing Centre Local Court and fined $20,000.
Zebde Developments Pty Ltd
15 July 2024
On 22 August 2023 and 31 August 2023, a SafeWork NSW inspector observed a new dwelling under construction without adequate fall protection in place at Condell Park.
After a SafeWork NSW investigation the defendant, Zebde Developments Pty Ltd, was charged with two breaches of clause 79(2) of the Work Health and Safety Regulation 2017.
On 15 July 2024, the Downing Centre Local Court convicted and fined the defendant $1,500 for the first offence and convicted wiht no additional penalty under s. 10A of the Crimes (Sentencing Procedure) Act for the second offence.
Linda June Priest

On 1 June 2021, a 43 year old labour hire worker, was assisting another worker in undertaking a controlled hazard burn reduction in a paddock, when the quadbike he was operating rolled over, causing serious injury at Borenore.
After a SafeWork NSW investigation the defendant, Linda June Priest, was charged with a breach of sections 32/19(1) and section 46 of the Work Health and Safety Act 2011.
On 11 July 2024, the defendant was convicted by the District Court and fined $8,500 for the section 32/19(1) charge and $3,400 for the section 46 charge.

On 26 May 2023, workers were observed with inadequate fall protections or fall prevention methods in place at Wollongong.
After a SafeWork NSW investigation the defendant, Australian First Construction Group Pty Ltd, was charged with a breach of clause 79(2) of the Work Health and Safety Regulation 2017.
On 3 July 2024, the defendant was convicted by the Downing Centre Local Court and fined $2,000.
UPX Pty Ltd

On 14 December 2023, three workers were observed with inadequate fall protection or fall prevention methods at risk of fall from a pitch tiled roof at Sawtell.
After a SafeWork NSW investigation the defendant, UPX Pty Ltd, was charged with a breach of clause 79(2) of the Work Health and Safety Regulation 2017.
On 1 July 2024, the defendant was convicted by the Downing Centre Local Court and fined $2,500.

Integrated Agricultural Developments Pty Ltd

On 1 June 2021 a labour hire worker, was assisting another worker in the task of controlled hazard burn reduction when the quadbike he was operating rolled over, causing serious injury at Borenore.
After a SafeWork NSW investigation the defendant, Integrated Agricultural Developments Pty Ltd, was charged with a breach of section 46 and 32/19(1) of the Work Health and Safety Act 2011.
On 27 June 2024, the defendant was convicted by the District Court and fined $15,000 and $180,000 respectively.
B & E Foods Pty Ltd

On 12 December 2022 workers were working on a loading dock in the absence of guardrails at Blacktown.
After a SafeWork NSW investigation the defendant, B & E Foods Pty Ltd, was charged with a breach of section 33/19(1) of the Work Health and Safety Act 2011.
On 25 June 2024, the defendant was convicted by the Downing Centre Local Court and fined $25,000.
Saunders Civilbuild Pty Ltd
20 June 2024
On 12 August 2021 a worker sustained serious injuries when he fell approximately 5 metres through a void between two bridge planks into a riverbed below at Gilgandra.
After a SafeWork NSW investigation the defendant, Saunders Civilbuild Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 20 June 2024, the defendant was convicted by the District Court and fined $300,000.
Topdeck Scaffolding Pty Ltd

On 9 April 2021 scaffolding on the east side of a 5-storey unit complex was undergoing renovations collapsed and struck the ground floor unit of an occupied neighbouring building, with some scaffold components smashing through a living room window at Fairlight.
After a SafeWork NSW investigation the defendant, Topdeck Scaffolding Pty Ltd, was charged with a breach of section 32/19(2) of the Work Health and Safety Act 2011.
On 14 June 2024, the defendant was convicted by the District Court and fined $150,000.
Steggles Pty Ltd
14 June 2024
On 6 October 2020 a worker was seriously injured when his right hand was caught in an overhead shackle conveyor line and dragged by the conveyor line through a hock cutter blade, severing it from his body at Beresfield.
After a SafeWork NSW investigation the defendant, Steggles Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 14 June 2024, the defendant was convicted by the District Court and fined $160,000.
Laggner Constructions Pty Ltd

On 19 October 2021 a worker was injured when he fell approximately 2.9m through an unsecured sheet of plywood covering a void at Murrumbateman.
After a SafeWork NSW investigation the defendant, Laggner Constructions Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 3 June 2024, the defendant was convicted by the District Court and fined $75,000.
May 2024
MTN Constructions Pty Ltd
27 May 2024
On 23 August 2023 a prohibition notice was issued. On 24 August 2024 the PCBU breached the notice.
After a SafeWork NSW investigation the defendant, MTN Constructions Pty Ltd, was charged with a breach of section 197 of the Work Health and Safety Act 2011.
On 27 May 2024, the defendant was convicted by the Downing Centre Local Court and fined $3,000.
Edstein Creative Pty Ltd
17 May 2024
On 14 February 2019, a worker was diagnosed with silicosis as a result of the inhalation of airborne respirable crystalline silica (RCS) while performing work tasks between 2012 and 2018 at Newcastle and Hunter regions.
After a SafeWork NSW investigation the defendant, Edstein Creative Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 17 May 2024, the defendant was convicted by the District Court and fined $375,000.
This matter is currently subject to a conviction appeal.
Keks Projects Pty Ltd

On 23 September 2020 a worker suffered serious injuries when he fell approximately 4.5 metres into an excavation pit when the temporary edge protection he was leaning against gave way at Caringbah.
After a SafeWork NSW investigation the defendant, Keks Projects Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 1 May 2024, the defendant was convicted by the District Court and fined $180,000.
Karl O’Sullivan

On 1 February 2021 a truck driver suffered fatal injuries while securing products on his truck when an unattended forklift rolled down backwards crushing him against the side of the truck.
After a SafeWork NSW investigation the defendant, Karl O’Sullivan, was charged with a breach of section 32/28(b) of the Work Health and Safety Act 2011.
On 1 May 2024, the defendant was convicted by the District Court and fined $7,500.
Orica Australia Pty Ltd
1 May 2024
Between about July 2014 and 6 December 2019, two workers were exposed to cobalt dust, a known respiratory sensitising agent which can cause occupational illness, while undertaking work at an industrial chemical manufacturing facility at Kooragang.
After a SafeWork NSW investigation the defendant, Orica Australia Pty Ltd, was charged with a breach of section 31(1)/19(1) of the Work Health and Safety Act 2011.
On 1 May 2024, the defendant was convicted by the District Court and fined $1,200,000.

On 24 August 2020 a worker was seriously injured when he was struck by a bundle of 6 metre steel reinforcement bars being moved by a tower crane at Edmondson Park.
After a SafeWork NSW investigation the defendant, Glenn Page, was charged with a breach of section 28(b) of the Work Health and Safety Act 2011.
On 24 April 2024, the defendant was convicted by the District Court and fined $6,000.
Jonathan Brian Simnett

On 12 November 2021 a licensed asbestos assessor knowingly altered a Certificate of Analysis and produced it in compliance with the WHS Act/Regulations without indicating the respect in which it was false.
After a SafeWork NSW investigation the defendant, Jonathan Brian Simnett, was charged with a breach of section 268(2)(a) of the Work Health and Safety Act 2011.
On 19 April 2024, the defendant was convicted by the Downing Centre Local Court and fined $2,500.
Miller Logistics Pty Ltd
18 April 2024
On 4 November 2020 a truck driver was seriously injured when he was struck by a forklift while loading freight onto a B-Double trailer at Tamworth.
After a SafeWork NSW investigation the defendant, Miller Logistics Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 18 April 2024, the defendant was convicted by the District Court and fined $450,000.
Visy Board Proprietary Ltd

Between 13 to 19 April 2021 a sole trader conducted training and high risk work license assessment, and allowed people to carry out high risk work when they were not authorised. Mr Samad was not an accredited high risk work license assessor at Macquarie Park.
After a SafeWork NSW investigation the defendant, Mazin Abdel Samad, was charged with a breach of section 43(2) and four breaches of section 268(1) of the Work Health and Safety Act 2011.

On 7 December 2017, a 42 year old contractor was fatally injured when he was trapped by an anchor blade inside an industrial ink holding tank while cleaning, at Auburn. Two other workers were also injured attempting to assist the trapped contractor.
After a SafeWork NSW investigation the defendant, Buddco Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
Following a defended hearing, the defendant was convicted by the District Court and on 2 May 2023 was fined $600,000.

On 9 April 2018, it was discovered by staff at the Belmont Station of the Hunter Zone of the Ambulance Service of NSW, that vials of Fentanyl contained within the restricted medication safe had been tampered with. On 11 April 2018, SafeWork NSW was notified of suspected tampering with restricted medications in the Hunter Zone.

On 4 August 2020, SafeWork NSW conducted a site inspection at premises of Excellent Financial Services Pty Ltd (“Excellent”) in Eastwood. An improvement notice was issued in relation to inspection and tagging of portable fire extinguishers. The improvement notice was not complied with and Excellent was subsequently charged with failing to comply with an improvement notice under s. 193 of the Work Health Safety Act 2011 (the Act).
On 15 October 2020, SafeWork conducted a site inspection at Excellent’s Eastwood premises and an improvement notice was issued in relation to requirement to notify SafeWork of Schedule 11 chemicals that exceed the manifest quantity. The improvement notice was not complied with and Excellent was subsequently charged with failing to comply with an improvement notice under s. 193 of the Act.
On 11 September 2020, SafeWork conducted a site inspection at Excellent’s Alexandria premises. Excellent was issued with an improvement notice in relation to fire extinguisher inspection and testing. The improvement notice was not complied with. Excellent was subsequently charged with failing to comply with an improvement notice under s. 193 of the Act.
On 26 September 2022, the defendant was convicted by the Local Court on two of the section 193 offences and fined $4500 for each offence. The third section 193 offence was taken into consideration by the court on a Form 1 pursuant to s. 32 of the Crimes (Sentencing Procedure) Act 1999.

On 30 May 2019, a 20 storey residential and commercial building under construction, was inspected by SafeWork NSW and safety hazards were observed,including inadequate edge protection, inadequately protected penetrations, falling objects, inadequate housekeeping and electrical hazards. On 12 June 2019 SafeWork NSW returned to the site and identified five electrical items that had not been inspected and tested by a competent person.
