On 22 May 2018, an apprentice carpenter sustained serious injuries when he fell 3 metres through an unprotected stairwell onto a concrete floor, at Glenmore Park.
After a SafeWork NSW investigation, the corporate defendant, Askfay Pty Ltd, and the director, Anthony Grima, were respectively charged with a breach of section 32/19(1) and 32/20(2) of the Work Health and Safety Act 2011.
On 22 October 2021, the defendants were convicted and fined by the District Court. The corporate defendant was fined $375,000 and the director was fined $37,500.
J A Investment Group Pty Ltd

On 15 December 2018, three workers sustained serious burns due to an explosion which occurred when an electric gurney was switched on to clean an area containing engines and fuel tanks in a Smithfield automotive yard.
After a SafeWork NSW investigation, the defendant, J A Investment Group Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 22 October 2021, the defendant was convicted by the District Court and fined $180,000.
Craig Eiszele

On or about 11 February 2019, an accredited high risk work licence assessor falsified documents relating to ten alleged high risk work licence assessments.
After a SafeWork NSW investigation, the defendant, Craig Eiszele, was charged with a breach of section 45 of the Work Health and Safety Act 2011 (Act), and ten breaches of section 268(1) of the Act.
On 20 October 2021, the defendant was convicted by the Local Court and fined $15,000 for the breach of section 45 of the Act, and fined $5,000 for each of the ten breaches of section 268(1) of the Act.
ABC Tissue Products Pty Ltd

On 10 January 2019, a worker was putting a tarp over a large stack of pulp bales when he fell 3.1 metres to the ground, at Wetherill Park.
After a SafeWork NSW investigation, the defendant, ABC Tissue Products Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 15 October 2021, the defendant was convicted by the District Court and fined $450,000.
Silver Stone Hardware Pty Ltd

On 20 March 2018, a worker sustained crush injuries when a load of glass panels fell on him while he was holding them onto an A-Frame rack by hand, at Balmain.
After a SafeWork NSW investigation, the defendant, Silver Stone Hardware Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 15 October 2021, the defendant was convicted by the District Court and fined $225,000.
Six Pound Australia Pty Ltd

On 6 February 2020, SafeWork NSW issued two notices under section 155 of the Act requiring the defendant to provide information and documents regarding the formwork collapse incident that occurred at Gosford on 25 May 2019. The defendant failed to comply with the notices.
The defendant, Six Pound Australia Pty Ltd, was charged with two breaches of section 155(5) of the Work Health and Safety Act 2011.
On 13 October 2021, the defendant was convicted by the Local Court and fined $3,300 for each offence.
Hofly Construction Pty Ltd

On 4 October 2019, two SafeWork NSW inspectors attended a multi-level construction site at Caringbah and found risks of fall from heights, trip hazards and objects falling.
After a SafeWork NSW investigation, the defendant, Hofly Construction Pty Ltd, was charged with a breach of section 33/19(1) of the Work Health and Safety Act 2011.
On 12 October 2021, the defendant was convicted by the Local Court and fined $25,000.
