Prosecution guidelines
SafeWork NSW has the discretion to prosecute offences under workplace health and safety (WHS) legislation but does so only when it serves the public interest.
Prosecutions aim to change offender behaviour, deter others, and reinforce compliance with the law.
SafeWork is committed to prosecuting significant breaches as outlined in its policy, but decisions to prosecute are based on law and public interest, not political influence.
