Dukes Painting Services Pty Ltd

01 October 2025

On 13 August 2022, a worker was placed at risk of falling from height while working on a mobile elevated working platform.

After a SafeWork NSW investigation the defendant, Dukes Painting Services Pty Ltd, was charged with a breach of sections 33/19(1) of the Work Health and Safety Act 2011.

On 1 October 2025, the defendant was convicted by the Industrial Court of NSW and fined $105,000.

BKH Contractors Group Pty Ltd

03 October 2025

On 7 June 2022, a 49-year-old worker fell approximately 5.5 metres from a temporary platform to below scaffolding, whilst hooking up components to a crane hook.

After a SafeWork NSW investigation the defendant, BKH Contractors Group Pty Ltd, was charged with a breach of sections 32/19(1) of the Work Health and Safety Act 2011.

On 3 October 2025, the defendant was convicted by the District Court and fined $150,000.

Mills & Watson Plumbing Pty Ltd  and Christopher Allan Mills

03 October 2025

On 9 June 2022, a 19-year-old 3rd year plumbing apprentice, was clearing out a 300mm trench with a shovel when a section collapsed on top of him.

After a SafeWork NSW investigation the defendants, Mills & Watson Plumbing Pty Ltd, and the Director, Christopher Allan Mills, were respectively charged with a breach of sections 32/19(1) and sections 32/27(1) of the Work Health and Safety Act 2011.

On 3 October 2025, the defendants were convicted by the District Court. The corporate defendant was fined $225,000 and the director defendant was fined $22,500.

Wade Jervis

17 October 2025

On 27 October 2023 a 19 year old worker sustained 5% body coverage of second degree burns and psychological injuries as a consequence of a workplace prank.

After a SafeWork NSW investigation the defendant, Wade Jervis, was charged with a breach of sections 32/28(b) of the Work Health and Safety Act 2011.

On 17 October 2025, the defendant was convicted by the Downing Centre Local Court and fined $20,000.

Nepean Engineering Innovation Pty Ltd

21 October 2025

On 13 February 2022, a 42 year old worker, was seriously injured  when he was struck by metal debris while working on level 7 of a pre-heater tower.

After a SafeWork NSW investigation the defendant, Nepean Engineering Innovation Pty Ltd, was charged with a breach of sections 32/19(1) of the Work Health and Safety Act 2011.

On 21 October 2025, the defendant was convicted by the District Court and fined $225,000.

Michael Shane Smith

24 October 2025

Between 22 September 2021 and 16 October 2021, SafeWork NSW inspectors were subjected to unacceptable behaviour by CFMEU NSW organiser, Michael Smith.

After a SafeWork NSW investigation the defendant was charged with two breaches of sections 33/28(b) of the Work Health and Safety Act 2011.

On 24 October 2025, the defendant was convicted by the Downing Centre Local Court and fined $1,700 for each charge.

Bridgeworks (Aust) Pty Ltd

24 October 2025

On 11 November 2022, a 35 year old carpenter sustained a broken right leg when he fell approximately 3.85 metres off a concrete abutment under construction.

After a SafeWork NSW investigation the defendant, Bridgeworks (Aust) Pty Ltd, was charged with a breach of sections 32/19(1) of the Work Health and Safety Act 2011.

On 24 October 2025, the defendant was convicted by the Industrial Court and fined $150,000.

JBS Australia Pty Ltd

29 October 2025

On 14 July 2022, a 56 year old worker sustained serious injury to his leg after being struck by a forklift in a palletizing area.

After a SafeWork NSW investigation the defendant, JBS Australia Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 29 October 2025, the defendant was convicted by the District Court and fined $330,000.

2 Types Constructions Pty Ltd

29 October 2025

On 19 April 2022, a worker sustained serious injury when he fell 4 metres through a skylight on the roof landing on the first floor below.

After a SafeWork NSW investigation the defendant, 2 Types Constructions Pty Ltd, was charged with a breach of sections 32/19(1) of the Work Health and Safety Act 2011.

On 29 October 2025, the defendant was convicted by the District Court and fined $270,000.

Wrigley Metal Roofing Co Pty Ltd

29 October 2025

On 25 July 2022, a worker sustained injuries when he fell 4 metres from a 2 storey house under construction

After a SafeWork NSW investigation the defendant, Wrigley Metal Roofing Co Pty Ltd, was charged with a breach of sections 32/19(1) of the Work Health and Safety Act 2011.

On 29 October 2025, the defendant was convicted by the District Court and fined $225,000.

SFS Management (Aust) Pty Ltd

31 October  2025

On 25 October 2022, seven workers were on the roof of an industrial cool room, moving equipment, when the roof gave way. The workers fell approximately 5 metres into the cool room.

After a SafeWork NSW investigation the defendant, SFS Management (Aust) Pty Ltd, was charged with a breach of sections 32/19(1), and a breach of section 46, of the Work Health and Safety Act 2011.

On 31 October 2025, the defendant was convicted by the Industrial Court of NSW and fined $480,000 and $20,000 respectively.
