Rapid Demolition Pty Ltd

30 September 2025

On 1 November 2023, the defendant, Rapid Demolition Pty Ltd, was issued with a Notice requiring it to provide information to SafeWork NSW in relation to a possible contravention of the Work Health and Safety Act 2011. The defendant failed to provide the requested information to SafeWork NSW by the required time or at any time thereafter

Rapid Demolition Pty Ltd, was charged with a breach of Section 155(5) of the Work Health and Safety Act 2011.

On 30 September 2025, the defendant was convicted by the Downing Centre Local Court of NSW  in its absence and fined $4,500.

Pacific Tissue Pty Ltd

19 September 2025

On 8 March 2023, a 19 year old  machine operator was feeding paper into a tissue manufacturing machine when her left hand was drawn into the machine rollers.

After a SafeWork NSW investigation the defendant, Pacific Tissue Pty Ltd, was charged with a breach of Section 32/19(1) of the Work Health and Safety Act 2011.

On 19 September 2025, the defendant was convicted by the Industrial Court of NSW and fined $150,000.

Kellogg (Aust) Pty Ltd

19 September 2025

On 3 March 2023, two workers were on a scissor lift (elevated approximately 3 metres) inside the loading dock of a warehouse.  A truck driver arrived on site,  and reversed the truck into the loading dock, striking the scissor lift which fell to the ground with the two workers inside.

After a SafeWork NSW investigation the defendant, Kellogg (Aust) Pty Ltd, was charged with a breach of Section 32/19(1) of the Work Health and Safety Act 2011.

On 19 September 2025, the defendant was convicted by the Industrial Court of NSW and fined $510,000.

BI Australia Pty Ltd

17 September 2025

On 11 February 2022, a 43 year old  Forklift operator was injured  when a forklift struck him while he was working.

After a SafeWork NSW investigation the defendant, BI Australia Pty Ltd, was charged with a breach of Section 32/19(1) of the Work Health and Safety Act 2011.

On 17 September 2025, the defendant was convicted by the District Court and fined $400,000.

Hilltop Meats Pty Ltd

17 September 2025

On 20 October 2021 , a 32 year old worker, was filling bags of meal when the main auger became blocked. Another worker turned on the isolation switch, entangling the worker in the auger screw.

After a SafeWork NSW investigation the defendant, Hilltop Meats Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 17 September 2025, the defendant was convicted by the District Court and fined $750,000.

Custom Bus Group Pty Ltd

17 September 2025

On 2 May 2022 a worker was driving a forklift in a yard when it came in contact with a still in the yard and overturned.
After a SafeWork NSW investigation the defendant, Custom Bus Group Pty Ltd, was charged with a breach of section 33/19(1) of the Work Health and Safety Act 2011.

On 17 September 2025, the defendant was convicted by the District Court and fined $170,000.

August 2025

Menai Civil Contractors Pty Ltd

19 August 2025

On 11 November 2022, a 35-year-old carpenter sustained a broken leg when he fell approximately 3.85 metres off the top of a concrete abutment that was under construction

After a SafeWork NSW investigation the defendant, Menai Civil Contractors Pty Ltd , was charged with a breach of section 33/19(1) of the Work Health and Safety Act 2011.

On 19 August 2025, the defendant was convicted by the Industrial Court of NSW and fined $69,750.

Aria Carpentry & Construction Pty Ltd

8 August 2025

On or about 31 March 2022, a 40-year-old worker was seriously injured when he fell approximately 7 metres off an incomplete and unsafe scaffold to the ground below.

After a SafeWork NSW investigation the defendant, Aria Carpentry & Construction Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 8 August 2025, the defendant was convicted by the District Court and fined $135,000 with an adverse publicity order made.

Tiger Electrical Solutions Pty Ltd

8 August 2025

On 11 February 2022, a worker was conducting electrical work in the roof cavity of a detached garage of a residential property, when the owner found the worker deceased.

After a SafeWork NSW investigation the defendant, Tiger Electrical Solutions Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011 (WHS Act).

On 8 August 2025, the defendant was convicted by the District Court and fined $300,000 and ordered to comply with a section Project Order under section 238 of the WHS Act.

Crestville Holdings Pty Ltd, Michael Garben and Simon Stevens

8 August 2025

On 13 October 2021, a 27 year old visitor was using the assisted rope climbing wall at Sydney Indoor Climbing Gym when he fell approximately 13m to the ground, sustaining fatal injuries.

After a SafeWork NSW investigation the corporate defendant, Crestville Holdings Pty Ltd was charged with a breach of section 32/19(2) of the Work Health and Safety Act 2011 (WHS Act). Director defendants Michael Garben and Simon Stevens, were each charged with a breach of section 32/27(1) of the WHS Act.

On 8 August 2025 the defendants were convicted by the District Court. The corporate defendant was fined $281,250 and the director defendants were fined $84,375 each.

July 2025

AWB Contractors Pty Ltd

23 July 2025

On 27 January 2021 a worker sustained fatal injuries when the cables of a crane used to lift a submerged yacht broke and fell onto him.

After a SafeWork NSW investigation the defendant, AWB Contractors Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 23 July 2025 the defendant was convicted by the District Court and fined $765,000.

Bellabrae Homes Pty Ltd

11 July 2025

On 9 June 2022, a 19 year old plumbing apprentice, was clearing out a trench with a shovel when a 2m high unsupported excavation collapsed on him.

After a SafeWork NSW investigation the defendant, Bellabrae Homes Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011 (WHS Act).

On 11 July 2025, the defendant was convicted by the District Court and fined $225,000 and imposed a  Publicity order under section 236 of the WHS Act.

Duralina Pty Ltd

11 July 2025

On 3 September 2021, a 38 year old worker sustained serious crush injury when his hand was caught in fine rollers whilst attempting to restart a mill.

After a SafeWork NSW investigation the defendant, Duralina Pty Ltd, was charged with a breach of section 32/21(2) of the Work Health and Safety Act 2011.

On 11 July 2025, the defendant was convicted by the District Court and fined $56,250.

Harbour City Roofing Pty Ltd

10 July 2025

On 9 February 2021, a 25 year old worker was seriously injured when he fell 5.5m through a roof structure to the ground below.

After a SafeWork NSW investigation the defendant, Harbour City Roofing Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 10 July 2025, the defendant was convicted by the District Court and fined $600,000.

SG Interior Linings Pty Ltd

10 July 2025

On 6 May 2022, a 38 year old worker was working in a window portal on the first floor of a refurbished library when he fell 5m resulting in head and spinal injuries.

After a SafeWork NSW investigation the defendant, SG Interior Linings Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 10 July 2025, the defendant was convicted by the District Court and fined $90,000.

465 Leichhardt Pty Ltd

2 July 2025

On 2 September 2022 a 33 year old woman and 3 small children sustained serious injuries when a gate came out of the fence frame and fell onto them.

After a SafeWork NSW investigation the defendant, 465 Leichhardt Pty Ltd, was charged with a breach of section 32/20(2) of the Work Health and Safety Act 2011.

On 2 July 2025, the defendant was convicted by the Industrial Court of NSW and fined $180,000.

June 2025

Civil 1 Pty Limited

27 June 2025

On 19 August 2020, a section of a scaffold surrounding the site collapsed due to wind onto a pedestrian footpath striking a member of the public, damaging vehicles and a light pole.

After a SafeWork NSW investigation the defendant, Civil 1 Pty Limited, was charged with a breach of section 197 of the Work Health and Safety Act 2011.

On 27 June 2025, the defendant was convicted by the District Court and fined $90,000.

Mazin Abdel Samad

2 June 2025

In August 2023, Mr Samad is alleged to have not complied with a s155 notice issued upon him for information in relation to a SafeWork investigation.

After a SafeWork NSW investigation the defendant, Mazin Abdel Samad, was charged with a breach of section 155/(5) of the Work Health and Safety Act 2011.

On 2 June 2025, the defendant was convicted by the Downing Centre Local Court and fined $1,100.

May 2025

Danrae Remedial Services Pty Ltd

23 May 2025

On 12 November 2021, a 34 year old worker and 19 year old trainee were welding plastic on site when the product they were working on caught fire.

After a SafeWork NSW investigation the defendant, Danrae Remedial Services Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 23 May 2025, the defendant was convicted by the District Court and fined $150,000.

Built by EPS Pty Ltd and Paul Wahhab

16 May 2025

On 11 January 2022, a 28-year old worker was pulling formwork components from around a duplex swimming pool, when he tripped and fell backwards landing on an uncapped steel reinforcement bar protruding from the pool.

After a SafeWork NSW investigation the defendant, Built by EPS Pty Ltd, was charged with breaches of section 32/19(1) of the Work Health and Safety Act 2011 (WHS Act) and clauses 40(a), 79(2) and 298(1)(b) of the Work Health and Safety Regulation 2017.

The director of Built by EPS P/L, Paul Wahhab, was charged with a breach of section 32/27(1) of the WHS Act. .
On 16 May 2025, the defendants were convicted by the District Court. The corporate defendant was fined a total of $159,000 for all charges. The director defendant was fined $15,000 and a training order was imposed under s. 241 of the WHS Act.

Hibernian Contracting Pty Ltd

14 May 2025

On 17 August 2022, a 42 year old labourer sustained serious injuries when he was using an angle grinder to detach a tank inside a pit causing an explosion.

After a SafeWork NSW investigation the defendant, Hibernian Contracting Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 14 May 2025, the defendant was convicted by the Industrial Court of NSW and fined $180,000.

Flash Homes Pty Ltd

12 May 2025

On 7 August 2023, a notifiable incident occurred when a 51 year old worker sustained serious injury when he fell from a height. The incident was notified to SafeWork NSW on 16 August 2023. The incident site was disturbed before an inspector could attend.

After a SafeWork NSW investigation the defendant, Flash Homes Pty Ltd, was charged with a breach of sections 38(1) and 39(1) of the Work Health and Safety Act 2011.

On 12 May 2025, the defendant was convicted by the Downing Centre Local Court and fined $4950 for each offence.

Newcastle Roofing Professionals Pty Ltd

2 May 2025

On 8 November 2021, a worker was replacing the roof of a two storey house when he slipped and fell 4.2m to the ground, striking a handrail as he fell.

After a SafeWork NSW investigation the defendant, Newcastle Roofing Professionals Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 2 May 2025, the defendant was convicted by the District Court and fined $300,000.

March 2025

Jungheinrich Australia Pty Ltd

26 March 2025

On 2 December 2021, a worker was operating a 7T forklift to retrieve a cable drum. As he alighted the forklift it moved and pinned him resulting in fatal injuries.

After a SafeWork NSW investigation the defendant, Jungheinrich Australia Pty Ltd, was charged with a breach of section 32/19(2) of the Work Health and Safety Act 2011 (the Act).

On 26 March 2025, the defendant was convicted by the District Court and fined $150,000 with a Project Order imposed under s. 238 of the Act.

State Asphalt Services Pty Ltd

21 March 2025

On 21 May 2021, a worker was fatally injured when he was run over by a large dump truck.

After a SafeWork NSW investigation the defendant, State Asphalt Services Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 21 March 2025, the defendant was convicted by the District Court and fined $450,000.

Demolition 1 Pty Limited

21 March 2025

On 5 August 2021, a worker was demolishing a masonry structure using an excavator, and while attempting to rake bricks with the excavator bucket, the structure collapsed, with a section falling outwards onto the public footpath and roadway.

After a SafeWork NSW investigation the defendant, Demolition 1 Pty Limited, was charged with a breach of sections 32/19(1) and 33/19(2) of the Work Health and Safety Act 2011.

On 21 March 2025, the defendant was convicted by the District Court and fined $75,000 and $15,000 respectively for the offences.

Abdul El-Hawly

21 March 2025

On 23 August 2021, a 28 year old worker was injured when he became entangled in a rope which was fed into a wood chipper. The incident resulted in the amputation of his legs.

After a SafeWork NSW investigation the defendant, Abdul El-Hawly, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 21 March 2025, the defendant was convicted by the District Court and fined $60,000.

Galvatech Pty Ltd

21 March 2025

On 11 February 2022, a 43 year old male Forklift operator was injured when a forklift struck him while he was working.

After a SafeWork NSW investigation the defendant, Galvatech Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 21 March 2025, the defendant was convicted by the District Court and fined $225,000.

Bhullar Steel Australia Pty Ltd

20 March 2025

On 4 August 2021, a 25-year-old worker was injured when he was using a gantry crane and magnetic lifter to lift a steel frame, and the frame separated from the lifter and fell on the worker.

After a SafeWork NSW investigation the defendant, Bhullar Steel Australia Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 20 March 2025, the defendant was convicted by the District Court and fined $270,000.

February 2025

Saveba Pty Ltd

26 February 2025

On 12 February 2022, a 22 year old worker was operating a motorised pallet rider when he collided with another pallet rider and his right foot got caught sustaining injury.

After a SafeWork NSW investigation the defendant, Saveba Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 26 February 2025, the defendant was convicted by the District Court and fined $390,000.

John Keough

24 February 2025

On 15 December 2022, a worker was undertaking the task of unloading hay when a hay bale fell off the forklift pinning the worker against the side of the shed.

After a SafeWork NSW investigation the defendant, John Keough, was charged with a breach of section 32/28 of the Work Health and Safety Act 2011.

On 24 February 2025, the defendant was convicted by the Wagga Wagga Local Court and fined $5,000.

Bede Burke

24 February 2025

On 15 January 2020, two workers were performing maintenance and repair work on a manure conveyor when one of the workers had his hand pulled into the pinch roller when he put it on the conveyor belt for support.

After a SafeWork NSW investigation the defendant, Bede Burke, was charged with breaches of section 32/19(1), 38(1) and 39(1) of the Work Health and Safety Act 2011.

On 24 February 2025, the defendant was convicted by the District Court on each of the offences. He was fined $30,000 for the section 32/19(1) offence with no other penalty imposed for the section 38(1) and 39(1) offences under section 10A of the Crimes (Sentencing Procedure) Act.

Georgia Campbell

19 February 2025

On 13 July 2022, a truck driver sustained injuries to his right foot when it was run over by a forklift while stacking roofing panels to be loaded onto a truck for delivery.

After a SafeWork NSW investigation the defendant, Georgia Campbell, was charged with breaches of sections 32/28 and 43(1) of the Work Health and Safety Act 2011 (the Act).

On 19 February 2025, the defendant was convicted by the District Court for both offences. She was fined$5,000 for the section 32/28 offence, with no other penalty imposed for the section 43(1) offence under section 10A of the Crimes (Sentencing Procedure) Act.

The defendant was also ordered to complete a training order under section 241 of the Act.

Berry Raymond Campbell

After a SafeWork NSW investigation the defendant, Berry Raymond Campbell, was charged with a breach of section 32/27(1) of the Work Health and Safety Act 2011.

On 19 February 2025, the defendant was convicted by the District Court and fined $45,000.

HMR Supplies Pty Ltd

19 February 2025

After a SafeWork NSW investigation the defendant, HMR Supplies Pty Ltd, was charged with breaches of section 32/19(1), 38(1), 39(1) and 43(2) of the Work Health and Safety Act 2011.

On 19 February 2025, the defendant was convicted by the District Court and fined $150,000 for the section 32/19(1) offence and $5000 each for the section 38(1), 39(1) and 43(2) offences.

Multiquip Poultry Pty Ltd

12 February 2025

On 16 August 2021, a 19 year old male worker was fatally injured when he was struck by a forklift during poultry catching operations.

After a SafeWork NSW investigation the defendant, Multiquip Poultry Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 12 February 2025, the defendant was convicted by the District Court and fined $300,000.

Poultry Enterprises (NSW) Pty Ltd

12 February 2025

On 16 August 2021, a 19 year old male worker was fatally injured when he was struck by a forklift during poultry catching operations.

After a SafeWork NSW investigation the defendant, Poultry Enterprises (NSW) Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 12 February 2025, the defendant was convicted by the District Court and fined $300,000.

Silver Raven Pty Ltd

6 February 2025

On 1 September 2021, a 58 year old water blaster operator, was undertaking high pressure blasting when a metal connector between the gun assembly and hose failed. The hose struck the operator resulting in serious injuries.

After a SafeWork NSW investigation the defendant, Silver Raven Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 6 February 2025, the defendant was convicted by the District Court and fined $180,000.

January 2025

Forte Di Pietra Pty Ltd

20 January 2025

On 8 June 2023, an improvement notice was issued to the defendant pursuant to s. 191 of WHS Act. The notice specified a compliance date of 7 July 2023. There was a failure to comply.

After a SafeWork NSW investigation the defendant, Forte Di Pietra Pty Ltd, was charged with a breach of section 193 of the Work Health and Safety Act 2011.

On 20 January 2025, the defendant was convicted by the Downing Centre Local Court and fined $9,000.
