On 8 June 2023, an improvement notice was issued to the defendant pursuant to s. 191 of WHS Act. The notice specified a compliance date of 7 July 2023. There was a failure to comply.
After a SafeWork NSW investigation the defendant, Forte Di Pietra Pty Ltd, was charged with a breach of section 193 of the Work Health and Safety Act 2011.
On 20 January 2025, the defendant was convicted by the Downing Centre Local Court and fined $9,000.
