Workplace Exposure Standard (WES) exceedance notification
If you are processing a high-risk crystalline silica substance (CSS) and there is an exceedance of the workplace exposure standard (WES), you must notify SafeWork NSW and submit the relevant air monitoring report.
When you need to notify
You must notify SafeWork NSW:
- when one or more WES exceedance is above the 8hr exposure standard of 0.05mg/m3, or the adjusted WES for extended work shifts (for example, 12hr shifts)
- as soon as reasonably practicable, but no later than 14 days from the date you receive the air monitoring result.
Information you will need to provide
When notifying SafeWork NSW, you will need:
- a copy of the air monitoring report completed by a competent person
- additional information such as the total number of tests and total exceedances.
A competent person is someone who has acquired competency through training, qualification or experience the knowledge and skills required to carry out the task.
The results of all air monitoring reports must be made readily available to people at the workplace who may have been exposed. This applies whether an exceedance has been recorded or not. PCBUs should be mindful of privacy legislation when making reports available to workers.
The PCBU must also ensure that air monitoring reports are kept for 30 years.
