November 2020
Auen Grain Pty Ltd

On 17 May 2018, a farmhand was injured when a bundle of steel SHS being moved by a mobile crane and suspended by chain slings slipped and struck him on the upper leg, at Mungindi.
After a SafeWork NSW investigation, the defendant, Auen Grain Pty Ltd, was charged with a breach of section 38(1) and two counts under section 43(2) of the Work Health and Safety Act 2011.
On 30 November 2020, the defendant was convicted by the Local Court and fined $3,000 under section 38(1) and $7,500 for each count under section 43(2).
John Bernard Cross

On 15 March 2018, a 52 year old truck driver sustained serious injuries when an inadequately restrained Western Star Double Truck attached with two trailers rolled forward, crushing him between it and the rear of a Side-Lifter Truck, at Tomago.
After a SafeWork NSW investigation, the defendant, John Bernard Cross, was charged with a breach of section 32/27(1) of the Work Health and Safety Act 2011.
On 6 November 2020, the defendant was convicted by the District Court and fined $3,750.
JBS Australia Pty Limited

On 16 February 2017, a worker suffered burns after being asked to assist in creating a firebreak with a front end loader he was operating when a grass fire broke out at Caroona. The worker later passed away in hospital.
After a SafeWork NSW investigation, the defendant, JBS Australia Pty Limited, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 6 November 2020, the defendant was convicted by the District Court and fined $300,000.

ABC Tissue Products Pty Ltd

On 15 February 2017, a worker sustained serious head injuries when she came into contact with a 1.86 tonne roll of paper being unloaded from a forklift at a factory in Wetherill Park.
After a SafeWork NSW investigation, the defendant, ABC Tissue Products Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 23 October 2020, the defendant was convicted by the District Court and fined $300,000.
Deicorp Pty Ltd

On 8 October 2016, a 49 year old worker fell approximately 2 metres through an open penetration, which was covered by an unsecured piece of plywood, at a Kellyville construction site.
After a SafeWork NSW investigation, the defendant, Deicorp Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 23 October 2020, the defendant was convicted by the District Court and fined $170,000.
Lendlease Engineering Pty Limited

On 23 May 2017, a worker conducting maintenance on the water treatment plant for the Northconnex Project was fatally injured when a 120mm pressurised pipe dislodged and struck him in the chest, at Beecroft.
After a SafeWork NSW investigation, the defendant, Lendlease Engineering Pty Limited, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 2 October 2020, the defendant was convicted by the District Court and fined $375,000.

Bullock MFG Pty Ltd

On 31 August 2017, an inexperienced worker suffered partial amputation of three fingers when his right hand was caught in a die press, Wallbank Power Press machine, at Rydalmere.
After a SafeWork NSW investigation, the defendant, Bullock MFG Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.
On 19 August 2020, the defendant was convicted by the District Court and fined $165,000.
