Raymond Elia
On 30 November 2022, a concrete placing unit made contact with overhead powerlines worker resulting in an electrical discharge that placed people at risk of electric shock and electrocution. Raymond Elia was the site supervisor. No persons were injured.
Alleged breach
Raymond Elia allegedly contravened section 28(d) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Raymond Elia will undertake include:
- A lessons learnt article about the incident in a construction industry publication
- Share personal reflections about the incident with builders and concrete pump operators to provide education to prevent similar incidents
- Undertake accredited work health and safety training to increase skills and knowledge.
This undertaking has a total expenditure of $23,500.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 or section 34C industrial manslaughter offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Raymond Elia in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings - Guidelines for Proposing a WHS Undertaking”.
