Multiplex Constructions Pty Ltd
On 7 June 2022, a worker suffered serious injuries after falling approximately five metres when a temporary work platform failed in a lift shaft. The worker landed on two other workers working in the lift shaft below.
Alleged breach
Multiplex Constructions Pty Ltd contravened section 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Multiplex Constructions Pty Ltd will undertake include:
- Collaboration with the Construction Safety Research Alliance to share expertise and research on energy-based safety within the workplace and the wider construction industry, including the delivery of knowledge sharing sessions for industry, and the development of industry guides and case studies.
- Allocation of a Multiplex resource as Chairman of SHINe to assist in industry leading safety standards and governance, including the delivery of two key industry research projects.
This undertaking has a total expenditure of $278,230.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Multiplex Constructions Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings Guidelines”.
