Austip Recycling Pty Ltd
On 19 April 2022, a worker suffered fatal injuries after being struck by a reversing telehandler while walking through a waste recycling centre.
Alleged breach
Austip Recycling Pty Ltd contravened section 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Austip Recycling Pty Ltd will undertake include:
- install a new Construction and Demolition Waste Recycling System that provides safety improvements at the site including better separation of people and plant;
- install a pedestrian detection system on all mobile plant
- third party accreditation to ISO 45001
- fund the delivery of mental health first aid training for Austip Recycling Pty Ltd workers and others in the waste industry
- share lessons learnt with industry through a presentation at the Waste Contractors and Recycling Association Safety Summit
- support the delivery of a community literacy program for the Blacktown Sudanese community.
This undertaking has a total expenditure of $1,094,000.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Austip Recycling Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings Guidelines”.
