HSR Notification Portal – privacy collection notice
Who we are
Your information is being collected and held by the SafeWork NSW Agency (SafeWork NSW). SafeWork NSW is the primary work health and safety regulator in New South Wales. It operates under the legislative mandate of the Work Health and Safety Act 2011 (WHS Act) and is responsible for engaging with the NSW community to prevent work-related fatalities, serious injuries, and illnesses and securing compliance with work health and safety laws. On 1 July 2025, it was formally established as an independent regulator under the Work Health and Safety Amendment (Standalone Regulator) Act 2025.
Why we collect your personal information
The collection of this information is required to enable SafeWork NSW’s law enforcement function as the work health and safety regulator. SafeWork NSW is collecting personal information for the purposes of allowing a person conducting a business or undertaking (PCBU) to fulfil their requirements under sections 74 and 97A of the Work Health and Safety Act 2011 (WHS Act). The information types listed below are required to enable SafeWork to establish and maintain a database to assist its inspectors with their work and improve SafeWork NSW insights about where work health and safety issues are emerging,
The kinds of information we require
- Name of the PCBU for the business or undertaking
- Business ABN
- Business trading name
- PCBU Contact name (contact person’s name for the PCBU)
- PCBU work phone number
- PCBU work email address
- Industry type
We may also require the following from a PIN submission:
- Date of issue
- Date compliance required by
- Postcode of the site location where the contravention occurred, or is occurring
- The provision of the Act or Regulation that is being, or has been contravened
- Brief description of how the provision is, or has been contravened
- Upload copy of PIN
- Business size
We may collect the following information of PCBU Administrators:
- The first name, last name and email address for the individual registering for the portal.
- The name and contact details (email and phone number) for the PCBU contact.
- The HSR list for the workplace, which may include, but is not limited to
- HSR’s name
- identifying if Primary or Deputy HSR (indicated as mandatory)
- HSR work phone number
- HSR work email address
- HSR election date
- workplaces covered by workgroup
- personal or health information that may be contained within a provisional improvement notice.
- personal or health information that may be collected in your feedback for the form.
Failure to provide information
You are lawfully required to provide SafeWork NSW with the following information:
- an up-to-date list of HSRs as soon as practicable after such is prepared.
- A copy of a provisional improvement notice issued by a Health and Safety Representative as soon as practicable after the notice is issued
Failure to do so may mean you are in breach of your obligations under the WHS Act.
Please do not provide us personal or health information that is not required by us or that is not necessary to provide.
How we may use the information you provide
The information you provide will be used by SafeWork NSW:
- To register you for and provide you access to the portal and allow you to provide SafeWork NSW with a list of your HSRs and Deputy HSRs for each work group, and any PINs that are issued to the PCBU by a HSR.
- For internal administrative purposes, including to establish and maintain a database to assist the SafeWork inspectorate with their work, and in relation to compliance, investigations, and enforcement of the WHS Act and the Work Health and Safety Regulation 2025.
- To support more informed policy making, program management, evaluation, research, and service planning as it can facilitate more efficient service delivery for the public of NSW.
- Artificial intelligence (AI) technologies may be used to assist in processing, analysing, or responding to the information you provide. All use of AI is conducted in accordance with applicable privacy laws and data protection standards
- For other directly related purposes.
Who we may share your information with
Where SafeWork NSW is permitted, authorised or required to use or disclose data or information in accordance with legal requirements or a law of the State or Commonwealth, measures will be taken to minimise the unnecessary disclosure of personal information.
We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where, if necessary, you have given consent. Our privacy statement describes when this may occur.
Your right to access and correct your personal information
