1. Who we are
Your information is being collected by SafeWork NSW, the NSW Work Health and Safety Regulator. SafeWork NSW is the primary work health and safety regulator in New South Wales. It operates under the legislative mandate of the Work Health and Safety Act 2011 (WHS Act) and is responsible for engaging with the NSW community to prevent work-related fatalities, serious injuries, and illnesses and securing compliance with work health and safety laws. On 1 July 2025, it was formally established as a stand-alone regulator under the Work Health and Safety Amendment (Standalone Regulator) Act 2025.
2. Why are we collect your personal information
We collect your personal information for the purposes of contacting you about policy development and evaluation, associated with the Work Health and Safety (Digital Work Systems) Amendment Act 2026, including consultation on thedevelopment of guidelines under section 118A of the WHS Act (Guidelines).
3. The kinds of personal information we collect
We may collect the following personal information:
- Your full name and contact details (including your phone number and email address).
4. Whether you are required by law to provide us with this information
Your information is provided voluntarily however if you choose not to provide your information, we will be unable to contact you to invite you to participate in consultation.
5. How we may use this information
We may use the information we collect in the following ways:
- To contact you, extending an invitation to participate in one or more rounds of consultation throughout the process of developing the Guidelines.
- Internal administrative purposes, including liaising with you in relation to any input or feedback you have provided about the Guidelines.
- To contact you about other consultation and engagement opportunities related to any future regulatory changes to the WHS Act and Regulation.
- To support more informed policy making, program management, evaluation, research, and service planning as it can facilitate more efficient service delivery for residents and business in NSW.
- To contact you in relation to future reviews of the Work Health and Safety (Digital Work Systems) Amendment Act 2026, including in relation to the review required under s 276E, for the Minister to review the relevant provisions to determine whether the policy objectives of the relevant provisions remain valid, the terms of the relevant provisions remain appropriate for achieving the objectives, and the operation of the relevant provisions has resulted in any adverse outcomes.
- Other directly related purposes, as permitted by law.
6. Who we may share your information with
On 1 July 2025, SafeWork NSW was established as an Executive Agency related to the Department of Customer Service (DCS). DCS provides some corporate service functions to SafeWork NSW under a formal agreement and assists with our business operations by providing software and storing data on our behalf. We will not disclose your information to anybody else unless we are authorised or permitted to do so by law, or where you have given consent. Information collected through this form will not be shared externally; however, The Office of the Minister for Work Health and Safety may request a list of stakeholders who have expressed their interest and may request their contact details. 7. Protecting your information
We will store and manage your information in accordance with the provisions of the PPIP Act. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
