On 9 January 2020, a labourer sustained fatal injuries when he was removing batons from a roof. While attempting to access the ladder he stepped on fragile material and fell through the structure, falling 2.5 metres onto concrete, at Wollongong.
After a SafeWork NSW investigation, the defendant, Empire Contracting Pty Ltd was charged with a breach of section 32/19(1) of the Work Health Safety Act 2011.
On 30 September 2022, the defendant was convicted by the District Court and fined $300,000.30/10/202230/09/2025
KML Auto Electrics Pty Ltd

On 15 January 2020, an 18 year old first year apprentice sustained fatal injuries when the cabin of a truck fell upon him, at Brocklehurst.
After a SafeWork NSW investigation, the defendant,KML Auto Electrics Pty Ltd was charged with a breach of section 32/19(1) of the Work Health Safety Act 2011.
On 30 September 2022, the defendant was convicted by the District Court and fined $375,000.
Excellent Financial Services Pty Ltd

On 4 August 2020, SafeWork NSW conducted a site inspection at premises of Excellent Financial Services Pty Ltd (“Excellent”) in Eastwood. An improvement notice was issued in relation to inspection and tagging of portable fire extinguishers. The improvement notice was not complied with and Excellent was subsequently charged with failing to comply with an improvement notice under s. 193 of the Work Health Safety Act 2011 (the Act).
On 15 October 2020, SafeWork conducted a site inspection at Excellent’s Eastwood premises and an improvement notice was issued in relation to requirement to notify SafeWork of Schedule 11 chemicals that exceed the manifest quantity. The improvement notice was not complied with and Excellent was subsequently charged with failing to comply with an improvement notice under s. 193 of the Act.
On 11 September 2020, SafeWork conducted a site inspection at Excellent’s Alexandria premises. Excellent was issued with an improvement notice in relation to fire extinguisher inspection and testing. The improvement notice was not complied with. Excellent was subsequently charged with failing to comply with an improvement notice under s. 193 of the Act.
On 26 September 2022, the defendant was convicted by the Local Court on two of the section 193 offences and fined $4500 for each offence. The third section 193 offence was taken into consideration by the court on a Form 1 pursuant to s. 32 of the Crimes (Sentencing Procedure) Act 1999.
SY Electrical Pty Ltd

On 1 December 2021, a site inspection by SafeWork NSW found two workers placed at risk of falling 5 metres and 2.4 metres while installing a residential roof top solar system on a double storey home at North Ryde.
After a SafeWork NSW investigation the defendant, SY Electrical Pty Ltd was charged with a breach of clause 79(2) and clause 299(1) of the Work Health and Safety Regulation 2017.
On 21 September 2022, the defendant was convicted by the Local Court and fined $8,000 for each offence.

On 5 November 2019, a worker sustained fatal injuries after being struck on the head by a hydraulic powered ramp of a trailer while unloading two vehicles, at Ingleburn.
After a SafeWork NSW investigation, the defendant, ACN 158 085 217 Pty Ltd was charged with a breach of section 32/19(1) of the Work Health Safety Act 2011.
On 21 September 2022, the defendant was convicted by District Court and fined $360,000.
Riverwall Constructions Pty Ltd

On 11 February 2019, a worker was fatally injured from electric shock when he came into contact with a nearby overhead powerline while removing a 6 metres metal roof rail fall protection, at Moorebank.
After a SafeWork NSW investigation, the defendant, Riverwall Constructions Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health Safety Act 2011.
On 14 September 2022, the defendant was convicted by the District Court, fined $600,000, and ordered to undertake a health and safety project pursuant to section 238 of the Act within six month of the date of the orders.
Advanced Roofing Sydney Pty Ltd

On 9 July 2019, a worker fell through an open penetration, approximately 8.42 metres to the round below, while installing new roof sheets at St Joseph’s College in Hunter’s Hill.
After a SafeWork NSW investigation, the defendant, Advanced Roofing Sydney Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health Safety Act 2011.
On 14 September 2022, the defendant was convicted by the District Court, fined $150,000, ordered to undertake a work health and safety project pursuant to section 238 of the Act, and arrange Certificate IV training in Work Health and Safety pursuant to section 241 of the Act.14/10/202214/09/2025
