Wingecarribee Shire Council
On 28 October 2018, two workers receive serious injuries, when a 15tonne crane being used to dismantle a centrifuge, came into contact, or was in close proximity to 11,000kV overhead powerlines.
Alleged breach
Wingecarribee Shire Council contravened sections 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Wingecarribee Shire Council will undertake include:
- Develop and implement an automated WHS induction program for Council
- Develop and implement a Council contractor management program
- Implement a WHS cultural improvement program at Council; and
- Implement a community safety awareness program as part of National Safe Work Month, that is repeated each October, for the life of the EU.
This undertaking has a total expenditure of $601,104.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Wingecarribee Shire Council in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
