S & L Steel Fab Pty Ltd
On 12 October 2018, a welder sustained serious crush injuries when a one tonne impeller being welded to a large metal disc fell onto him. During the task, the impeller and holding fixture detached from the welding positioner and fell forward onto the worker.
Alleged breach
S & L Steel Fab Pty Ltd contravened section 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities S & L Steel Fab Pty Ltd will undertake include:
- engage a WHS training provider to deliver leadership and due diligence training
- develop and implement a multilingual audio-visual induction program in English, Spanish, Korean and Chinese
- undertake a WHS audit of plant and equipment at the site and implementation of corrective actions
- develop two online training courses in collaboration with Weld Australia for industry
- provide funding towards WHS education scholarships to students of TAFE studying Certificate IV in WHS.
This undertaking has a total expenditure of $504,260.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by S & L Steel Fab Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
