H.B. Fuller Company Australia Pty Ltd
On 18 September 2018, two workers engaged by H.B. Fuller Company Australia Pty Limited at its South Windsor site suffered injuries, when an explosion emanated from a tank which from time to time contained highly flammable hazardous materials, as a result of hot work being undertaken on the tank.
Alleged breach
H.B. Fuller Company Australia Pty Ltd contravened section 19(1) and 32 of the Work Health and Safety Act 2011.

Activities H.B. Fuller Company Australia Pty Ltd will undertake include:
- implementation of a Safety Leadership Training Program for managerial/supervisory staff
- employment of a safety Plant Manager to specifically address WHS-related matters
- targeted audit of the incident site and implementation of post-audit action items
- safety training for employees and contractors
- industry education - partnership with NSCA Foundation Ltd
- employment of a safety/engineering Intern
This undertaking has a total expenditure of $624,400.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by H B Fuller Company Australia Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
