Merrywinebone Pty Ltd
On 17 May 2018 a farmhand sustained serious lacerations when a bundle of steel being moved by a mobile crane and suspended by chain slings slipped and struck him on the leg.
Alleged breach
Merrywinebone Pty Ltd contravened sections 38(1) and 43(2) of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Merrywinebone Pty Ltd will undertake include:
- Provide WHS training for farm managers and establish a safety management team;
- Fund a review of the Virtual Farm Safety online learning experience; and
- Make completion of the Virtual Farm Safety online learning experience, a requirement of induction for seasonal/itinerant staff and current full time employees who are engaged in farming activities across the business.
This undertaking has a total expenditure of $32,850
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Merrywinebone Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace and the industry
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”
