Cemento Constructions Pty Ltd
On 6 July 2018, glazing fell from a partially demolished façade onto the footpath and a major arterial road in southern Sydney. No workers or members of the public were injured in the incident.
Alleged breach
Cemento Constructions Pty Ltd contravened section 19(2) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Cemento Constructions Pty Ltd will undertake include:
- An independent third-party audit of the company’s workplace health and safety management system with a focus on sequencing of work, supervision, contractor management and falls from heights
- Safety leadership training for Directors, Managers and Supervisors
- Translation of safety documentation and visual safety signage
- Mental health first aid and general first aid training for additional workers
- Contribution to an industry awareness advertising campaign on ‘falls from heights’
- Installation of ‘falls from heights’ awareness messaging on Cemento Constructions Pty Ltd site shade cloth
- Partnership with Habitat for Humanity to update their WHS system
- A financial contribution to Habitat for Humanity towards the removal of asbestos at a Habitat for Humanity site.
- Provision of safety equipment and training to Habitat for Humanity.
This undertaking has a total expenditure of $171,192
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Cemento Constructions Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
