JR Electrical and Solar Pty Ltd

30 October 2019

On 02 August 2018, Penalty Notice was issued in relation to providing inadequate protection against the risk of fall, at St Kurri.

The defendant, JR Electrical and Solar Pty Ltd, after court electing the Penalty Notice, was charged with a breach of regulation 79(2) of the Work Health and Safety Regulation 2017.

On 30 October 2019, the defendant was convicted by the Local Court and fined $600.

Chemstore Group Pty Ltd

24 October 2019

On 17 March 2017, a 29 year old worker suffered injuries when he attempted to adjust a locking nut on a tank winder while the winder was still rotating, at Parkes.

After a SafeWork NSW investigation, the defendant, Chemstore Group Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 24 October 2019, the defendant was convicted by the District Court and fined $90,000.

Proflow Plumbing and Maintenance Pty Ltd

24 October 2019

On 21 July 2017, a 91 year old occupant of residential premises sustained fatal injury when he fell into an excavation trench dug by plumbers undertaking work at the premises, at Glenmore Park.

After a SafeWork NSW investigation, the defendant, Proflow Plumbing and Maintenance Pty Ltd, was charged with a breach of section 32/19(2) of the Work Health and Safety Act 2011.

On 24 October 2019, the defendant was convicted by the District Court and fined $300,000.

Miroslav Davidovic

24 October 2019

On 24 June 2016, the defendant, Miroslav Davidovic, carried out high risk work (dogging work) without holding a high risk work licence and also allowed a worker to carry out dogging work without the worker holding a high risk work licence as required by clause 81 of the Work Health and Safety Regulation 2011, at Unanderra.

After a SafeWork NSW investigation, the defendant was charged with a breach of section 43(1) and section 43(2) of the Work Health and Safety Act 2011 (the Act).

On 24 October 2019, the defendant was convicted by the District Court and fined $750 under section 43(1) and $1,500 under section 43(2) of the Act.

Kukas Brothers Pty Limited

24 October 2019

On 31 January 2017, a Labourer suffered a serious laceration to his leg when he fell from an excavator bucket being used to raise him out of an excavation pit, at Foster.

After a SafeWork NSW investigation the defendant, Kukas Brothers Pty Limited, was charged with a breach of 32/19(1) of the Work Health and Safety Act 2011.

On 24 October 2019, the defendant was convicted by the District Court and fined $120,000.

Superior Skills Pty Ltd

23 October 2019

On 19 September 2017, a worker suffered fatal injuries when he fell off a ladder at a farm in Murrami.

After a SafeWork NSW investigation, the defendant, Superior Skills Pty Ltd, was charged with a breach of section 38(1) of the Work Health and Safety Act 2011.

On 23 October 2019, the defendant was convicted by the Local Court and fined $30,000.

Emu Group Pty Ltd

04 October 2019

On 16 September 2016, a 31 year old painter suffered serious injuries when he fell from the fourth floor of a stair void while spray painting, at Fairfield.

After a SafeWork NSW investigation, the defendant, Emu Group Pty Ltd, was charged with a breach of section 32/19(1) of the Work Health and Safety Act 2011.

On 04 October 2019, the defendant was convicted by the District Court and fined $180,000.
