On 3 February 2006, a traffic controller sustained fatal injuries when an emulsion spray truck reversed into him at a road resurfacing work site.
After a WorkCover investigation the defendant the Roads and Maritime Services of NSW (formerly known as the Roads and Traffic Authority of NSW) was charged with a breach of the OHS Act 2000 section 8(2).
On 25 May 2012 the defendant was convicted by the Court and fined $150,000. You can read the judgment.
Nace Civil Engineering Pty Limited, Borthwick & Pengilly Asphalts Pty Ltd and Eagle Eye Traffic Services Aust Pty Ltd were also charged and convicted in relation to this fatal workplace incident.
