Complete Office Supplies Pty Ltd

On 22 February 2023, a labour hire forklift driver attempted to retrieve a loaded pallet from a top racking bay with a high reach forklift. The loaded pallet fell through the top racking bay into the adjacent aisle and fell from a height onto the worker, who was a store person employed by Complete Office Supplies Pty Ltd.
The worker suffered serious injuries.

Complete Office Supplies Pty Ltd contravened section 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Complete Office Supplies Pty Ltd will undertake include:
- Real-time, AI-driven CCTV monitoring to identify non-compliant pallet stacking practices
- Sharing lessons learned with the warehousing and logistics industry through a presentation at an industry seminar to share the story of the incident, lessons learned, and technology innovations created as a result of the Enforceable Undertaking.
This undertaking has a total expenditure of $376,000.00
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 or section 34C industrial manslaughter offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Complete Office Supplies Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
