Connect Traffic Management Pty Ltd
On 17 January 2022, a traffic control worker employed by Connect Traffic Management Pty Ltd was struck by an excavator while completing traffic control duties for a Connect Traffic Management Pty Ltd civil contractor.
Alleged breach
Connect Traffic Management Pty Ltd contravened section 19(1) and 33 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities Connect Traffic Management Pty Ltd will undertake include:
- A fitness for work / mental health initiative for Connect Traffic Management Pty Ltd workers
- An independent audit of Connect Traffic Management Pty Ltd’s management of the risk of people interacting with mobile plant
- A series of lessons learnt videos to be provided to registered traffic control trainers as a resource to be used during training for traffic controllers.
This undertaking has a total expenditure of $85,000.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by Connect Traffic Management Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable undertakings guidelines”.
