AMAC Holdings Pty Ltd
On 8 April 2022, two subcontractors were installing a shade sail in a playground. During the installation and tightening of the shade sail, a strap broke, and one of the workers was struck in the face by a shackle, causing him to fall approximately 4.5 metres from a ladder to the ground below, suffering serious injuries.
Alleged breach
AMAC Holdings Pty Ltd contravened section 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities AMAC Holdings Pty Ltd will undertake include:
- Undertake an independent audit of AMAC’s safety management system and implement recommended actions
- Provide additional training to installation staff which will be delivered by a registered training organisation
- Produce a technical training technical training manual: ‘Safe Rigging for Shade Installers’ for shade installers, which will be shared with industry
- Develop, trial and implement a new shade sail installation method, using a specific winch system, which will be shared with industry
- Present at the annual shade industry (Specialised Textiles Association) seminar, to share lessons learned, launch the technical training manual: ‘Safe Rigging for Shade Installers’ and share the new shade sail installation method.
This undertaking has a total expenditure of $282,000.
Reasons for accepting the undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 or section 34C industrial manslaughter offence, which if it was the case, would preclude the proposed undertaking from being accepted
- The nature of the alleged contravention and the actions taken by AMAC Holdings Pty Ltd in response to the incident are assessed as being appropriate for consideration of an undertaking
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community
- The undertaking addresses the requirements contained within the “Enforceable Undertakings - Guidelines for Proposing a WHS Undertaking”.
