H Design Manage Build Pty Ltd
On 28 September 2021 a 33 year old 4th year apprentice fell approximately 13 metres from the second level of a terrace house while working on a parapet caulking external windows and panels. The worker suffered serious injuries.
Alleged breach
H Design Manage Build Pty Ltd (HDMB) contravened section 19(1) and 32 of the Work Health and Safety Act 2011.
Summary of undertaking
Activities HDMB will undertake include:
- engage an accredited safety consultant to undertake an audit of their existing safety management system
- develop an integrated safety management system
- produce an improved company induction for employees
- create a new full time Safety Manager position
- provide height safety training for all relevant employees
- develop a roof edge protection training video, which will be translated into two languages and available online for use by apprentices and members of the Master Builders Association.
This undertaking has a total expenditure of $184,081.
Reasons for accepting undertaking
- The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted.
- The nature of the alleged contravention and the actions taken by HDMB in response to the incident are assessed as being appropriate for consideration of an undertaking.
- The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community.
- The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
