AGT Foods Australia Pty Ltd

On 24 March 2013, a worker employed by AGT Foods Australia (AGT Foods) (previously Australia Milling Group Pty Ltd) was repairing a screw auger. As he attempted to stand up, his foot depressed the start button and his arm became trapped between the moving parts.

Alleged breach

Section 19(1) of the Work Health and Safety Act 2011 (WHS Act), as a person with health and safety obligations prescribed under Section 32 of the WHS Act.

Summary of undertaking

Activities AGT Foods will undertake include:

  • providing training to Operations Managers and Work Health and Safety (WHS) Coordinators in Certificate IV WHS
  • conducting gap analysis audit of existing WHS management system
  • developing a certified WHS management system
  • providing training to Senior Executives and Managers: WHS Leadership and Culture workshop
  • developing a WHS Due Diligence Guideline
  • developing a case study to be published in Australian Grain
  • updating existing induction program for carriers and producers at all AMG sites
  • developing a regional television advertising campaign on Agricultural Chemical Safety.

This undertaking has a total expenditure of $180,325.

Reasons for accepting the undertaking

  • The alleged contravention does not appear to be a section 31 Reckless conduct category 1 offence, which if it was the case, would preclude the proposed undertaking from being accepted.
  • The nature of the alleged contravention and the actions taken by AGT Foods in response to the incident are assessed as being appropriate for consideration of an undertaking.
  • The strategies proposed in the undertaking have been assessed as likely to deliver long term sustainable safety improvements in the workplace, industry and community.
  • The undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
