1. Who we are
Your information is being collected and held by the SafeWork NSW Agency (SafeWork NSW). SafeWork NSW is the primary work health and safety regulator in New South Wales. It operates under the legislative mandate of the Work Health and Safety Act 2011 (WHS Act) and is responsible for engaging with the NSW community to prevent work-related fatalities, serious injuries, illnesses and securing compliance with work health and safety laws. On 1 July 2025, it was formally established as an independent regulator under theWork Health and Safety Amendment (Standalone Regulator) Act 2025.
SafeWork NSW gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act) and theHealth Records and Information Privacy Act 2002 (HRIP Act).
2. Why we collect your personal information
We collect your personal information so that we can properly assess your request, understand the circumstances surrounding your concerns, and take any necessary actions to support the effective resolution of the matter.

We may collect the following personal information:
- Full Name(s)
- Address(es)
- Email address(es)
- Contact phone number(s)
- Age (if under 25 years)
- Workplace location(s)
- Business name(s) ABN, and contact details
- Business Address
- Other worker or management name(s) and role(s)
- Health, injury, treatment and treatment provider details
- Personal and/or Health information
- Details of the alleged Psychosocial Hazard
- If the form is completed on behalf of someone else, a signed consent form must be uploaded.
4. Are you required by law to provide your information
Providing this information is voluntary. However, if you choose not to provide it, we may be limited in our ability to investigate the matter.
5. How we may use and disclose this information
We may use and disclose the information we collect in the following ways:
- To conduct inquiries or investigations: The information may be used to gather relevant facts, identify contributing factors, and undertake any necessary investigation into the concerns raised.
- To identify and manage health and safety risks: We may use the information to evaluate potential risks within the workplace and implement measures to eliminate or minimise those risks, in line with WHS responsibilities.
- To provide guidance or recommendations: The information assists us in offering appropriate advice, interventions, or referrals aimed at resolving the issue or improving workplace conditions.
- To communicate with relevant parties: Where appropriate and lawful, the information may be shared with internal stakeholders or external service providers involved in managing or resolving the matter. This is done on a strictly need‑to‑know basis.
- To meet legal or regulatory obligations: We may use or disclose the information when required to comply with WHS laws, privacy laws, or other statutory responsibilities.
- To maintain records for accountability: Information may be stored securely as part of our recordkeeping requirements to ensure transparency, auditability, and proper management of WHS matters.
- Ministerial support: To provide information and support to Ministers including the Minister for Work Health and Safety.
- Referral to other regulators: To refer matters reported to SafeWork NSW to other appropriate regulators.
- Service quality and feedback: To manage the quality of our service delivery and to seek your feedback.
- Policy, planning and evaluation: To support informed policy making, program management, evaluation, research, and service planning, including facilitating more efficient service delivery for the public of NSW.
- Emergencies: To use your information in emergencies to prevent or lessen a serious and imminent threat to life or health.
- Artificial intelligence technologies: To use artificial intelligence (AI) technologies to assist in processing, analysing, or responding to the information you provide. All use of AI is conducted in accordance with applicable privacy laws and data protection standards.
- Corporate services and data handling: On 1 July 2025, SafeWork NSW was established as an Executive Agency related to the Department of Customer Service (DCS). DCS continues to provide some corporate service functions to SafeWork under formal agreement and assist us with our business operations by providing software and storing data on our behalf. - Use with your consent: If you consent to another use or disclosure
- Other directly related purposes: For purposes directly related to the above or as otherwise required or authorised by law.
Where SafeWork NSW is permitted, authorised, or required to use or disclose information in accordance with legal requirements or a law of the State of NSW or the Commonwealth, measures will be taken to minimise the unnecessary disclosure of personal information. 6. Protecting your information
We will store and manage your information in accordance with the provisions of the PPIP Act and HRIP Act. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes, we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
