Who we are
Your information is being collected by SafeWork NSW Agency, the NSW Work Health and Safety Regulator. SafeWork NSW gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act). Why we collect your personal information
This form is part of the internal review process to ensure fairness and accountability in decisions made by an Inspector or Authorised Officer.
SafeWork NSW is collecting your personal information for the purposes of:
- Allowing our review team to assess the details of your application and any supporting documents to ensure an accurate and fair review of the original decision.
- Contacting you or your representative, if necessary, to clarify information or obtain additional details about your application.
- Notifying you of the outcome of the review and any related updates.
The kinds of personal information we collect
The personal information we collect includes, but is not limited to:
- Applicant’s name
- Applicant’s representative’s name (if applicable)
- Business name and trading name (if applicable)
- Address (residential or business)
- Mobile number and email address
- Date of the original decision
- Reference number/decision number
- Licence number (if applicable)
- Name of the officer who made the original decision.
- The reason the applicant believes the original decision was unreasonable, unfair, or incorrect.
- Attachments related to the original decision, such as a copy of the decision.
- Any other additional information provided in your submission.
Failure to provide information
This information is necessary for lodging an internal review application and is for a lawful purpose directly relating to SafeWork NSW’s function under Part 12, Division 2 of the Work Health and Safety Act 2011 (WHS Act) and the Fines Act 1996. Failure to provide this information may result in your request not being processed.
How we may use your information
We may use the information we collect in the following ways:
- To process and assess your application for an internal review.
- To review and evaluate the original decision in accordance with applicable laws and procedures.
- Internal administrative purposes, including liaising with you in relation to your application and in relation to compliance, investigations, and enforcement of the WHS Act and Work Health and Safety Regulation 2025.
- To support more informed policy making, program management, evaluation, research, and service planning as it can facilitate more efficient service delivery for residents and business in NSW.
- Other directly related purposes.
Who we may share your information with
We may share this information with the original decision-maker, their Manager, as well as other relevant people as determined by the circumstances of the internal review, such as experts if it is a technical issue.
We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where you have given consent.

Protecting your information
We will store and manage your information in accordance with the provisions of the PPIP Act. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes, we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
