1. Who we are

Your information is being collected and held by the SafeWork NSW Agency (SafeWork NSW). SafeWork NSW is the primary work health and safety regulator in New South Wales. It operates under the legislative mandate of the Work Health and Safety Act 2011 (WHS Act) and is responsible for engaging with the NSW community to prevent work-related fatalities, serious injuries, and illnesses and securing compliance with work health and safety laws.

On 1 July 2025, it was formally established as an independent regulator under the Work Health and Safety Amendment (Standalone Regulator) Act 2025.

SafeWork NSW gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

2. Why are we collecting this information?

We collect your email address, business size, industry type and assessment responses to provide your due diligence assessment and let you view past results.

3. Are you required by law to give us your information?

Providing this information is voluntary. If you choose not to provide it, you will not you will not be able progress with the tool or to view your previous assessment results if you choose to utilise this tool in the future.

4. How your information will be used and shared

The information you provide will be used by SafeWork NSW for;

  1. Generating a report for the user
  2. Internal administrative purposes, including sending a reminder email to re-assess using the tool at a future date
  3. Calculating industry benchmark scores once a minimum number of 20 assessments have been completed for a particular industry (or for a particular PCBU size, by reported numbers of workers).

    These benchmark scores may be shared with:

    • future users of the tool as a benchmark for their industry or PCBU size.
    • other NSW Government agencies, Safe Work Australia, and other Work Health and Safety Regulators for the purposes of improving the delivery of services, informing policy development and planning, conducting research and analytics, and identifying trends and needs across different populations, but will not be disclosed to any other party unless authorised by law or you have provided consent.

On 1 July 2025, SafeWork NSW was established as an Executive Agency related to the Department of Customer Service (DCS). DCS will continue to provide some corporate service functions to SafeWork NSW under formal agreement and assist us with our business operations by providing software and storing data on our behalf. 5. Protecting your information

We will store and manage your information in accordance with the provisions of the PPIP Act. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.

We will only keep information for as long as we need it to fulfil the purposes, we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
