1. Who we are
Your information is being collected by the SafeWork NSW Agency (SafeWork NSW). We give priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

2. Why we collect your personal information
SafeWork NSW is collecting this personal information for the purposes of:
- approving your Registered Training Organisation (RTO) to deliver asbestos and/or demolition related training and assessments in NSW in accordance with the Work Health and Safety Act 2011 (WHS Act) and the Work Health and Safety Regulation 2025 (WHS Regulation), or
- asbestos and/or demolition training notifications in accordance with the relevant SafeWork NSW RTO conditions, or
- updating RTO contact details.
3. The kinds of information we collect
We collect the following information:
- Authorised officer(s), trainer(s) and RTO contact person(s) name, position, and contact details (including phone number and email address).
- Authorised officer electronic signature(s).
- RTO name and contact details (including phone number, email and business addresses).
4. Failure to provide information
SafeWork NSW is required under the WHS Act and the WHS Regulation to collect this information for its assessment of your application.
5. How we may use this information
We may use the information we collect in the following ways:
- For determining your application for the delivery of asbestos and/or demolition related training and assessments in accordance with the WHS Act and the WHS Regulation.
- For auditing purposes to ensure the quality and integrity of asbestos removal and/or demolition training delivery and assessments.
- Internal administrative purposes, including liaising with you in relation to your application, and in relation to compliance, investigations, and enforcement of the WHS Act and the WHS Regulation.
- As required by legislation to record information on a public register, parts of which will be published online.
- To support more informed policy making, program management, evaluation, research, and service planning as it can facilitate more efficient service delivery for residents and business in NSW.
- Other directly related purposes.
6. Who we may share your information with
On 1 July 2025, SafeWork NSW was established as an Executive Agency related to the Department of Customer Service (DCS). DCS will continue to provide some corporate service functions to SafeWork NSW under formal agreement and assist us with our business operations by providing software and storing data on our behalf. To process and assess your RTO application to deliver asbestos removal and/or demolition training and assessments, and ensure compliance with relevant requirements, we may make enquiries and exchange information with the Australian Skills Quality Authority (ASQA) and/or a State Training Authority (STA) or other NSW Government agencies, or other States, Territories and/or the Commonwealth. We may disclose your information to such bodies for these purposes.
We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where you have given consent. For further information, please see our privacy statement.
7. Protecting your information
We will store and manage your information in accordance with the provisions of the PPIP Act. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes, we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.

8. Your rights
Subject to certain conditions, you have the right to access or correct your personal information. In situations where your safety or wellbeing may be compromised, you may request that your personal information be excluded from the public register.
