1. Who we are
This Privacy Collection Notice is intended for individuals providing notifications to SafeWork NSW regarding the intention to undertake licenced Asbestos Removal or Demolition work.
Your information is being collected and held by the SafeWork NSW Agency (SafeWork NSW). SafeWork NSW is the primary work health and safety regulator in New South Wales. Its functions, powers and operations are authorised under the Work Health and Safety Act 2011 (WHS Act) and the Work Health and Safety Regulation 2025 (NSW) (Regulation) and it is responsible for engaging with the NSW community to prevent work-related fatalities, serious injuries, and illnesses and securing compliance with work health and safety laws.
2. Why are we collecting this information
The collection of this information is required to enable SafeWork NSW’s law enforcement function as the work health and safety regulator. SafeWork NSW is collecting personal information for the purposes of allowing a person conducting a business or undertaking (PCBU) to fulfil their requirements under sections 74 and 97A of the WHS Act. The information types listed below are required to enable SafeWork NSW to establish and maintain a database to assist its inspectors with their work and improve SafeWork NSW insights about where work health and safety issues are emerging.

We collect the following kinds of personal information:
- Your full name
- Email address
- Phone/mobile numbers
- Licence Number
- Licence state
- Licence conditions
- Business ABN
- Business Trading name
- Business address
- Name of the provider undertaking the clearance certificate
- Contact phone number for the provider undertaking the clearance certificate
- Name of the nominated supervisor
- Contact information for the nominated supervisor
4. How we may use this information
We may use the personal information contained in your account for the purposes for which it was collected, including:
- To register you for and provide you access to the Online Notification System, and to enable you to submit required notifications to SafeWork NSW, including information relevant to your licence and associated obligations.
- Providing you with regulatory and licence related information, including updates or changes to legislation, reminders about safety requirements, notifications relating to your licence, and information about education, training, and events relevant to your licence obligations.
- Supporting regulatory functions, including maintaining internal databases to assist the SafeWork NSW inspectorate in compliance activities, investigations, and enforcement of the WHS Act and Regulation.
- Informing policy development and service improvement, such as program management, evaluation, research, and planning to deliver more efficient services for the people of NSW.
- Artificial intelligence (AI) technologies to assist in processing, analysing, or responding to the information you provide. All use of AI is conducted in accordance with applicable privacy laws and data protection standards.
- Other directly related purposes as permitted by law.
5. Whether you are required by law to provide us with this information
Licence holders are legally required to notify SafeWork NSW of the intention to undertake licensed asbestos removal and demolition work under the Regulation.
Failure to provide the required information may result in breach of your obligations under the Regulation.
6. Who we may share your information with
On 1 July 2025, SafeWork was established as an Executive Agency related to the Department of Customer Service (DCS). DCS provide some corporate service functions to SafeWork NSW under formal agreement and assist us with our business operations by providing software and storing data on our behalf. Further information on how DCS manage personal information.
We may also refer matters reported to SafeWork NSW to other appropriate regulators, such as the NSW Environment Protection Authority (EPA) or other relevant agencies, where this is necessary for regulatory, compliance, or safety purposes.
We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where you have given consent. For further information, please see our privacy statement.
7. Protecting your information
We will store, manage, and dispose of your information in accordance with the provisions of the PPIP Act, and we will only keep information for as long as we need it to fulfil the purposes, we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
We are legally obligated to protect your information by limiting collection to what is necessary and ensuring its secure disposal. All information is disposed of safely, with reasonable safeguards in place to prevent loss, unauthorised access, misuse, modification, disclosure, or any other improper use.
