Wood Group PSN Australia Pty Ltd

On 12 July 2013, two workers were exposed to unleaded petrol whilst performing a planned product transfer operation at the Caltex Banksmeadow Terminal from an unleaded petrol storage tank. During the activity a hose coupling failed resulting in an uncontrolled release of approximately seven percent of the tank’s content into the surrounding safety containment area.

ALLEGED BREACH

Wood Group PSN Australia Pty Limited contravened section 19(1) of the Work Health and Safety Act 2011.

SUMMARY OF UNDERTAKING

Activities Wood Group PSN will undertake include:

  • development and execution of a supervision upskilling program with an  emphasis on advancing safety practices.
  • implementation  of a SmartCard training and competency management process.
  • development and implementation of a Wood Group PSN ‘Worker Well-being’ programme to be used and shared with the wider Petroleum Industry.
  • production of two process safety educational videos to assist the onsite leadership and workers. In addition the videos will be made available to the wider petroleum industry.
  • formalisation of an internship for a New South Wales based student to gain practical HSE experience with Wood Group PSN.

This undertaking has a total expenditure of $398,080.

REASONS FOR ACCEPTING THE UNDERTAKING

  • the alleged contravention does not appear to be a section 31 reckless conduct category 1 offence, which if it was the case, would preclude the proposed enforceable undertaking from being accepted.
  • the nature of the alleged contravention and the actions taken by you in response to the incident are assessed as being appropriate for consideration of an enforceable undertaking.
  • the strategies proposed in the enforceable undertaking have been assessed as likely to deliver long term, sustainable work health and safety improvements in the workplace, industry and community.
  • the enforceable undertaking addresses the requirements contained within the “Enforceable Undertakings – Guidelines for Proposing a WHS Undertaking”.
